Question...I am working for a company as a contractor being paid by a staffing consultant. The contract ends in a few weeks. That will be the end of the 1 year contract. Will I be able to file for unemployment benefits? I worked as a W2 employee consistently for the entire year on the contract.
achris, If you are willing and able to work, you may be able to qualify. The only way you will know for sure is if you fill out your application. choose your state on from the list on our "Getting Unemployment" page to start the process.
I have a question, i recently had surgery on my hand for a workers comp issue. Now they approved my surgery back in jan. but waited til the day b4 my surgery to say they are not going to approve it now because it had been awhile since i seen a doctor. Well i called my doctor up and told him what was going on and he told me that he has the approved paperwork and to go ahead with surgery, so i did. Well the workers comp people are still trying to screw me around, i have not yet heard back from them and still am not recieving me weekly check. So i finally called a lawyer and am getting the ball rolling. My question is would it be ok to collect unemployment while i wait, my job has me down as "layed off" so technically i should be able too???
Choosy, you can only collect unemployment benefits if you are willing and able to work and actively looking for work. If that is not your situation, you will probably not qualify for unemployment benefits.

I accepted a position with this company starting off working approximately ten (10) hours per week due to the nature of the job. I was to start working forty (40) hrs on May 3, 2010. There was no office so our work communication consisted of email communication, occassional staff meetings someplace and telephone calls (mostly by emails). This was how I received my work assignments for the week. I reported status of assignments via email and awaited further directives from my boss/company's owner. I started working in February, 2010. After the first two pay checks, I started having problems getting my checks on the pay day designated (every two weeks). I had to call him to meet him to get my check, which was usually after the pay date we agreed upon. I usually had to travel where ever he was to get my check. The pay period I was to receive my first forty hours pay, the boss starting finding little things to complain about. He then said he had assigned my duties to others (his wife and cousin) who also worked for his company as administrative staff. I continued to email him daily for for work assignments as I had previously had done and he continued to say "he had no assignments" or "I assigned it to someone else". When I asked about my payday for the pay period, he replied he did not owe me because I had not done any work. The last ten hour pay check he advised, had not cleared his bank (bounced) and that he would pay me as soon as he could. A later email he started saying I was not giving my best and some other choice things. I have done lots of work for this preson/company and he admits in an earlier email that I have contributed a lot to the success of the company. I feel he was re assigning duties by design so he could say I had not done any work. That was not my fault as I made myself available as always by email for work assignments. In his late email, he explained he did not have the funds to pay me and that he would honor the last check that did not clear. This was the second check to not clear in this short employment. To date, he has not told me I am fired or laid off but that he hopes I see the big picture and continue to work for the company but understood if I choose not to. I have all of the emails correspondence along with lots of work assignments to show this was how I got my work assignments and the work I put to fulfill them. I also have the emails to verify everything I am saying in this email. I feel he owes me money as he did not make me aware that he was not able to pay me my forty hours per week salary until well after he decided to start reassigning work to his wife and cousin. To date, I still don't know if I was fired or laid off. He has been in business for several years and I believe this is a violation of work ethics. I just need to know if I can qualify for unemployment benefits until I receive get other employment?

Calynn, contact your state's unemployment agency and ask them. That is the only way to get an accurate answer.
I make approx $450.00 a week we are getting ready to close the location I work at I have been here approx 7 years any guestimates of how much unemployment I would receive? Or even better does anyone know what percentage of your wages you would get on unemployment??? Please help!!
I am currently employed however my boss is always finding something wrong.This all started when I became slightly disabled. I can still perform 99% of my job duties. I was out on disability for 13wks. When I came back she wrote me up for "reading a book for 3-4hrs at my desk on my last day of work. I explained I NEVER in 18yrs. have bought a book,mag.or anyother reading material into the office. She said I was lying. I am under extreme stress,have been to HR 2 different occasions for these issues. What would qualify me to collect unemployement while looking for other work? Thank you. LR

amre, you might be eligible for partial unemployment. the only way to know for sure is to apply for unemployment benefits and let your state determine if you are eligible.
I have a question...I currently live in the state of Ga. I worked for an airline and quit my job because I knew they were going to terminate me. The termination was due to a 30 day job performance that I had not failed in the three years of working there. However it is their company policy to terminate. I put a two week notice in and they let me work it. I got my separation notice in the mail and it says I am not rehirable due to not meeting company standards. It is now May and I am a full time student with a child. This all happened January 17, 2010 and it is now May. I never went to file for unemployment because I just now noticed what happened. Can I still file for unemployment so long after quitting/terminated from the airline? If so, what are my chances of getting unemployment benefits?
annie, you should go ahead and aplly and let your state make the determination. The worst that can happen is that they say no.

Jane, the only way to know is to apply. You should apply for unemployment in your area ASAP. You may be eligible for at least partial unemployment benefits but you won't know until you apply.
I need desperate help. I have worked for 30 years. At my last position I was a teacher who lost my job because I refused to inflate my students grades at a private Catholic School. When the parents saw their childrens' first report cards they told the principal that either I was dismissed or they would pull their children out of the school. Needless to say I was dismissed after only being there for 3 short months. However, at my previous position, I was injured while working and was put on disability for 18 months. So now the state of California is telling me that I do not qualify for Unemployment insurance for no earning enough money. How can this be.... I have worked for 30 years was injured on the job. Returned to the work force and then get fired. I have tried to appeal and I am just not knowlegdeable enough on unemployment law to win. I have no money and am at risk of becoming homeless. Who can advise me on this issues for free?

I had a fact finding interview on the phone last Monday answering why I was fired and then they called my employer and when he fired me he said, "I'm gonna have to let you go, its just not working out." He told the employment office that he let me go because I had lied on my application and that I was a felon. I have been charged with a felony before but never convicted and the application says "convicted of". Will this keep me from being accepted for unemployment benefits??
As long as you didn't lie on the application, it should go in your favor. The employer has to prove why it didn't work out.

You need go to your local UI office, and talk to someone about all the resources they have to offer. They have workshops to strenghten your skills and help to find employment and a career. You need to be job ready!! Do you have a great resume and cover letter?? The UI office can provde you with the latest labor market information in your area.

Hi all! My heart goes out to each and everyone one of you. I too am unemployed. I lost my job in August of 09. My whole department was outsourced, but since they outsourced my job to a local company before sending it overseas I don't qualify as Trade affected. I was with this company for 7 years working the the same department. My skills are virtually zero excecpt for some light proofreading and data entry skills. It seems as if the only jobs out there right now are the ones for people with degrees or can do fifty billion things at once and have lots of computer software skills. So I am trying to get back to school but need to find out if I can still collect unemployment while in school. Alot of things I am reading say you will lose your benefits if you attend school while on umemployment. I am so frustrated because it seems like the only way I can get back to work is to go back to school and acquire a degree or trade of some sort. My state offers a program called WIA(Dislocated workers program) and they are paying for funding to go back to school. The problem is that they have a waiting list of up to a year. So I am at the bottom of that pile right now waiting in line. In the meantime I watch the unemployment rate rise in TX and continue to send out resumes for jobs that I don't really qualify for. So I am in the same boat with everyone else. If you have a job hang on to it for dear life and make them fire you or lay you off. I pray this unemployment thing gets better soon. Hang in there everyone! Don't lose hope! I am not going to. There has to be some way to get to where we need to be.
Raecast and everyone else looking into school as a way to better your career, I would first recommend that you take a look at our Paying for College section as there are a number of ways to pay for school. I would also advise you not to be scared of student loans. Federal and state funded student loans are available to almost all students. You may be intimidated or put off by the idea of putting yourself in debt to go to school, but the truth is that as long as you stick to federal and state funded student loans and as ling as you complete your schooling, you should be able to graduate and qualify for a job that pays you enough to improve your living situation and still pay back your loans. Most federal and student loan payments are reasonable and you are will also be getting a much better interest rate than if you want through a private lender. They will also work with you for reasons of financial hardship.
Hello my name is tonya and i was laid off also. No you will not loose your benefits if you go back to school. you just have to make sure that the school you decide to go to will be accepted by unemployment. I would ask some of the students before deciding to enroll in any school, But you loose your unemployment for maybe a few weeks until you return the approval form they send to you.

Mn unemployment has said once get a job, no luck but another in the department said if you work under a certain # of hours per week you can still apply; I would double check with the department head.
Dena81, unemployment benefits are usually granted based on if you are working, not when you are getting paid. You should contact your local unemployment office and ask them this question, they are the only ones that can give you an accurate answer.
I work for a company that supplies on site calibrations to a auto company. I worked in the financial end for the department . My job has been eliminated, but my company wants me to replace another person. This job that I would be taking over is a less qualifying position, its below my job skills. Do I have to take it or can I quite and collect unemployment. If I can't collect unemployment I'll take this other job, I'm 60 years old.
MJ, you need to contact your state, explain your situation in detail and let them make the final determination. Generally, you cannot qualify for unemployment if you have turned down work, but every state and every situation is different. Contact your state's unemployment office.
I filed for unemployment in Illinois & was accepted, 1st check came, then came the Statement of Certification with my confirmation # and next date to call. I did so on 12-23-09. I received my direct deposit on 12-25 . I have yet to receive the next statement of certification letter. When it asks you in the teleserve menu how much you made in the weeks I was eligible for benifits i gave a different answer than before. I work a part time job and do not make over the alloted amount I can make and still receive benifits.
Ist certification I made $112.00 per week. This certification I stated I made $124.00 per week. Still way below what I am allowed to make. Culd this have somehow stopped my statement of certification letter from coming? Or could it just be the holidays holding it up.

DebbieH98. It could very well be that the holiday mail is slowing down your certification letter but there is no way to know for certain unless you contact the state of Illinois unemployment office. They are the only ones that can answer this question accurately.
I am retiring from M&m Mars on the 31st of December. I won't draw my retirement check till Feb. 3rd, my birthday.
So I would like to draw intill such time as I start recieving my retirement checks.
