Unemployment 101

Man holding lay-off notification

There are more than 8 million people without jobs in the United States. Many of them qualify for unemployment, but don’t know what it is and how to get it.

What is unemployment?
Unemployment is also called unemployment insurance. It is a program paid for by employers and your tax dollars when you’re working. If you lose your job and it’s not your fault, you could qualify. These benefits only last for a short time.

How much unemployment can you get and for how long?
The amount of benefits you get depends on how much money you made in the year before you lost your job. When you’re approved, you’ll get a check once a week while you’re looking for work.

Karlbauer,

Do you have any evidence? record of you being fired?

Hi,
I am a receiver of second UI benefit, in the mean time, I've been very active to look for the job. Unfortuantely, I even don't get any interview opportunities since this year after sending hundreds of Resumes.

Recently, one of my old friends working in a local international trading company, in my hometown overseas told me that their company has some business coorperatin opportunity and asked me whether I could go back and talk with his boss. But I am concerned that if I go there overseas for about 10 days for the cooperation discussion, my UI benefit will be stopped. But the trip is indeed to look for job.

Thank you.

Oh man, what a drag. "I got fired", they said I quit. I have already written back to New Jersey saying that I was fired, I just didn't feel like without a lawyer they would take me serious. Will the Benifts Tribunal Board take me serious? And can they still deny my benifts if it comes down to a he said she said situation?

can i draw unemployement for 1 day a week as my employer cut back from 40 to 32 hrs a week.

Ok, I am an insurance adjuster and have been working for major carriers for several years. In September of 08, I resigned from my position at a major carrier to work as a 1099 employee handling Hurricane Gustav and Ike claims. The assignment ended in January and now I'm unemployed. I've filed for unemployment but my claim is still under investigation and no decision has been made yet. I've been told the unemployment looks at the last 18 months of employment. Am I eligible or not?

Hey Jake,

You should contact the unemployment office and find out the limitations of unemployment benefits - particular your case. Call them with the objective to find out on "behalf of a friend" versus inquiring on your own behalf.

My California weekly benefit is $450.00. I made approximately $6,000.00 in one week renting my privately owned movie equipment as a 1099. When I fill in my continued claim, do I report this $6,000.00? I know the state will not pay me for that week, but will they continue to withhold benefits up to this $6,000.00? Or will they reduce my total benefit amount determined when I first filed.
I have searched the internet everywhere for this information but to no avail. I need help.!!!

Wayne,
I was laid off from my sales position last November from a struggling recruiting firm (we were tied to manufacturing go figure). I cited that I was laid off due to "lack of work". I just received notice from the unemployment office indicating that I may have falsified my information because my employer indicated I was fired due to lack of performance. It seems like semantics as my poor performance was directly related to lack of work available to our business and both reasons should qualify for Unemployment benefits in the State of Michigan. Needless to say, I'm a little freaked out here. What am I facing? Should I be worried that they will take away my benefits and charge me penalties? What does my previous employer have to gain from filing this discrepancy?

Thank you for your time,
Jake

I have a questions. i was recently let go and i have the opportunity to do a medical study for money. Do you know if this is something i need to claim as work to unemployment?

»

Barbour John

I do not think you do, but you should check your local unemployment office.

»

Marina,

Keep in mind, that the contract that you signed probably has a section that tells you what will happen to you if you should get laid off and whether or not you can get unemployment from the institution. I recommend that you check with your local government on finding out more information. Please also review our unemployment section on the beehive.

I am not eligible for unemployment benefits, because I worked for religion institute, which does’ not pay unemployment insurance. When I was hired 3 years ago, nobody notify me about it. Than I was layoff, my director did not tell me about it too. I applied for unemployment benefits and got a letter “I can’t be used to establish an unemployment benefit account. I think it is discrimination.
I worked as everybody in USA. Pay federal and state taxes from each paycheck. Now, in critical finance situation in our country, when unemployment rate is so high, and no chance to find jobs I was kicked off and ineligible for benefits as other people.
I would like to know how I could get support from government instead unemployment benefits.

Allison F,

I recommend going there in person if you can. Furthermore, most people call around their lunch time or afternoon before it closes. I recommend finding out when it opens and try calling in the first few minutes that it opens.

Hello Shellster13,

Frederico,

I am positive that you cannot. However, local and state laws may have a statue on starting your own business. Please check with them.

»

Jordan,

If you are still employed-you cannot receive unemployment benefits. If you are going to be laid off soon, start preparing your unemployment forms that can be found on your local /city unemployment office's website. Furthermore, you sound like a hard working young man and have a talent for being social. Utilize these skills that you have already and put them into your next job search and job. Good luck Jordan.

Hey Brooks,

I am not sure of where you are from(CITY/STATE), but I advise you to use GOOGLE.COM and type in your city, county, or state as well as workers compensation or unemployment office to find out more details on your unemployment. Furthermore, depending on your contract and the time that you have been employed by your employer-you should review it.

Hey James E23,

You should contact the social security office to find out further steps on a new SSN. Please visit, http://www.ssa.gov/

Identity theft is incredibly prevalent these days and please check with your credit bureau and review all purchases that you have made (check or credit cards).

Hey..

So I don't know if anyone can help me but I'd appreciate it if anyone could give me advice as to what to do for filing for unemployment under my circumstance. The thing is I have been working at a rustic log furniture store as an office manager for the past 8 months and just until recently, (about 3 months ago) my employer has had a hard time paying me on time and for as much as I'm supposed to be compensated for. He is behind on my hours a month and a half, and also 3 months behind on my percentage for commission of sales which typically adds $60-$100 per check which I get issued to me every two weeks. He always pays me at least a day or two late, and when I do try depositing it I get a $7 paper return fee for HIS insufficient funds. Sometimes I try going to his bank to cash it but again, he lacks the funds for me to get paid until usually a week or week and a half later than I was supposed to have been paid. The business isn't doing too good, and many people have been laid off already. The only reason I haven't is because my employer needs me there to keep the business going, for now. I'm sure I'll be laid off in a matter of time but would rather just be laid off now. I'm sure I could talk to him about it but if he can't afford to pay me isn't that a legitimate reason to file for unemployment? I'm worried about not being compensated for my work, and I cannot handle the stress of it all anymore. He's in debt to way too many people, we have horrible relations with resellers, vendors, shippers, and customers. My job is to be the office manager/receptionist, so I have to order supplies.. make up work orders and invoices.. do web work on the website.. and a LITTLE customer service. Since our business is falling behind so bad I can't get all my work done in a day and he puts me in the middle of him and the EXTREMELY ANGRY CUSTOMERS, VENDORS, SHIPPERS, RESELLERS, ETC. I feel like I am being taken for granted. I'm hoping that someone might be able to be willing to read this huge thing [lol] and provide some helpful advice. I'm not very familiar with this stuff. I just turned 19 actually so I really don't know what to do about the situation.

Please help!!

Thanks! :]

I live in California and was put on medical disability for longer than the 12 months protected by FEMLA so my company terminated me on the grounds of "not returning to work from disability leave in 12 weeks." Is this considered "not by my own fault?" I've worked full-time for 7 years for this company and believe I qualify otherwise. I know I cannot file until I am no longer disabled, but want to file ASAP when my disability is over. Thanks!

dtrch-
your first step should be to file for unemployment. You can find more information at the NYS Department of Labor. This is their website...http://www.labor.state.ny.us/unemploymentassistance.shtm.

tthompson,
congratulations to your husband for finally winning his unemployment claim. if your husband feels uneasy about taking his job back, he should work towards finding employment at another company. but, before he does that, he should check with his unemployment case worker to be sure that he won't loose the benefits by turning down a job.

Jobs Producer

»

Dogbowl,
You will not be able to get unemployment if you resign. Youc an only qualify for unemployment if you get fire and it was no fault of your own.

Hi kvandewa,
Your stituation is very complicated and i'm not sure that I fully understand it. It sounds like you need to seek the advice of an unemployment attorney OR you can visit you local unemployment office and see exactly what the qualifications are in your are. In addition, there may be other servcies that your husband can qualify for. You should contact your social services department and get more information on the services they provide.

»

Hey Phillip,
Unemployment is difficult. Your first step should be to contact your local unemployment agency and talk to someone about your situation. They will tell you how to qualify and give you paperwork to fill-out. This will get the process started. Good luck!
