You can get unemployment if you can answer "Yes" to all three of these questions:
EXPLANATION: The amount of benefits you get depends on how much money you made in the 12 months before losing your job. This is called your base period.
EXPLANATION: If you were laid off, fired, or left the company for a good reason (like an illness), you could qualify. You will not qualify if you quit your job.
EXPLANATION: You must be ready, willing, and able to work. You can’t be too sick, injured, or disabled to work.
Lucey, It sounds like you will be able to qualify for benefits but the only way to know for sure is to apply. Be completely honest and answer all of their questions as best you can and let the unemployment agency in your state make the final determination. Good luck.

Okay, so this is long and confusing, but it happened to me and I dont know what to do....so if someone can help here is my story. The placed I work at for 4 years (I was a manager for 2 years) randomly fires me, and the only reason he gave me was because he lost confidence in me, but would not give me a reason why he lost confidence in me. So this happened on Sunday September 20 and he had also talked to my mom and told her the reason I was fired was because I was too hard headed. He also told my mom that he thought I was stealing so he wanted to do an investigation before he gave me my separation notice. So today (Thursday September 24) my mom talked to him on the phone and said we wanted the separation notice today, he told me to come up there around a certain time so I did. When I got there he told me that I was now being demoted from manager (so i was just a server now) and that they were just suspending me, I wasn't fired. But its only because he had no proof of me stealing anything (because I didn't) and I would more than likely be able to claim unemployment so he just said never mind your not fired. Is this illegal in the state of Georgia? Now i cant claim unemployment? i either go back to work there, or I go get a new job and he just gets away with this?

I worked for 1.5 years in the sales department of a company successfully for a very challenging boss. I took a position in the marketing department of the same company and have been there for five months. I am currently on probation for "poor performance" but feel as though my boss has been abusing me, thus my poor performance. I don't think it qualifies as abuse officially because I haven't been attacked personally, or at least that's what HR says. She screams and yells at me, ignores me other times, doesn't give clear direction; as a result I have been so nervous and stressed that I have anxiety attacks, can't eat, or sleep. I was scheduled to work at noon on Friday. I ended up being truly sick and incapable of leaving the toilet for long periods of time. Also, I did not have my phone, so I had to wait to call in until I had my phone again. So, at noon, I received a call from my shift leader stating that "I was supposed to work at noon, and this was my last chance." So, about 30 mins. to a half hour later, I called in sick. My shift leader stated "you know you have to be done now, right?" So, I called the next day to verify and my boss said that I "quit" with a "no call, no show." However, I did call. It was just after my shift. I hear that the company is going to try especially hard to fight my case. They've already started, and I answered questions like "No, I could not give adequate warning when calling in. And yes, I have been warned that I could get fired. But I was sick, and I had no phone. So, it was out of my control." But I most definitely did not quit, and I DID call. I have proof as do they. I have had three write-ups in the past for absence. However, I've workerd there over a year. My last write-up was for walking out of work to go to the doctor. I got a doctor's note, and I walked away with a write-up stating that "another mistake of absence could result in termination."How do I fight my case? Can they really say that I quit?

Unemployment eligibility varies from state-to-state; however, one general requirement is that you or your employer paid into unemployment while you were working. I worked as a office assistant for 8 years until the company went under. I was making $16.95 an hour full time. I understood I had to take any job offered me. I took a job as a customer service rep for $9 hour 25 week. I make so little I still qualify for $100 week in unemployment.. The stress of the new job is really getting to me. The hours are 6am to 11am and I'm also having problems transportion. I have only been there 2 weeks. If I leave this job will they cut off all my benefits? I really need them to survive.

So ive worked for my company in NJ for 5 years now. I had a baby in June 2007. I told them at that time that i needed to have time with my baby and wanted to be apart of bringing her up. I then said i would have to resign unless they could move me to part time and to work from home which they allowed because I do so well for them. So i have been working 25 hours a week from home for the last year now. Daycare is perfectly worked out for my working hours. If you leave your child at this place for 6 or more hours its considered a full day pay rate. They have my daughter for 5 hours which means i have enough money to work and pay the childcare. Well my boss just told me because i didnt meet one quality standard by a .1 of a point & i have to return to working in the office. If I do this then the added commute to work makes daycare cost go up since she will then be at a 6 hour day rate. Thats 200.00 more a month! Cant afford it. My husband has been working for a company for 18 years. Without notice they reduced everyone's hours from 40 to 32. Can he claim unemployment for the 8 hours. It does not seem like a lot but when he makes close to $20 an hour, it makes a huge dent in our monthly earnings.

I worked for company (a) from 07/07 to 03/09, i filed for unemployment and got payments weekly. I accepted a position at company (b) in 05/09. On July 13th my mother in law was killed in a car accident and I took off the remainder of that week (4 days) to help my husband with funeral arrangements. I also needed to take off a 1/2 day the following Monday for estate issues. I notified my employer everyday that I needed to be off. I gave them almost week's notice about the 1/2 on Monday because an appointment was set up with Lawyer right away. I returned to work on July 20th for a 1/2 day, on July 21st at the end of the day I was told my probationary period was over and the company is severing our relationship DONE, not a word more. So I filed my unemployment, now it's been over a month and I haven't received benefits yet. Why would this take so long? I was already approved for unemployment for company (a) and that's still the one that would be used to calculate benefits. If I was let go at my 60 day probation why is there such a hold up?
My friend was let go from her company two weeks ago for telling her former boss off, she got a call from unemployment today telling her she would start getting benefits next week. I recently was getting unemployment benefits when the business that I worked for for 8 years and a $40,000 salary closed. After about 6 weeks I was offered a job with a new company. The payplan was a base salary plus commision. I was told that the other people in this same position make around $38,000 annually no problem. So I accepted this job based on this information. After a couple of weeks on the job I soon found out that this was not possible based on the amount of hrs turned and the number of employees who I depend on for my commision. Also after talking to other employees in the same position found that no one has even come close to making $38,000 a year. Then I got my first paycheck. Needless to say that by working for this company I would be making about $1,000 a month less than I was when I was on unemployment. I am a single dad with a six year old and struggled enough with my unemployment wages. I cannot even come close to making ends meet with this kind of pay so I quit to look for new employment. I would have never accepted this job if I was told the truth about the earning potential. Since I did quit under these circumstances am I still able to get unemployment benefits untill I find I job that more closely matches my previous pay or even a job that matches my unemployment benefits. I would much rather work just to make the same income as my benefit amount but $1,000 less a month is just something I cannot live on.

My job has been making me sick (literally) for nearly ten years. I teach high school, and am surrounded by sick kids constantly. From frequent exposure to cold and flu viruses, I started getting acute sinus infections ten years ago which are treatable only with potent antibiotics. Typically, I am on these medications from October through May. Now, the antibiotics are causing me huge digestive problems: Intestinal bleeding, diaharrea, nausea. I feel as if I am doing harm to my body by going to work. My principal will not allow me to send sick kids out of the room so I feel powerless to protect myself. My quality of life and my health are suffering as a result. Can I collect unemployment?
clynn, Generally if you leave a job of your own free will, you cannot qualify for unemployment. You should look into how to qualify for Workers Compensation or Disability Benefits in your state. I have worked at my last job for about 8 months and was written up twice for very unreasonable issues. I had such a bad experience working there that after speaking with the owner on several occassions regarding the issues, nothing was resolved or attempted to be resolved. I finally gave in and gave my 2 week notice, however, the owner said if you change your mind to stay you can, we have invested money in you and don't want to lose you. I thought about it and said o.k., I would like to stay and work it out. Two weeks after that I was approached by the owner again and he offered to me a termination without severance pay or to quit on my own with 2 weeks severance pay. At that time I figured I did not have a choice so I took the two weeks severance and wrote a resignation letter that he asked me to write. Am I eligible for unemployment?

I worked for company (A) from August 24th 2008 to June 14th 2009, company (B) Offered me a better position and higher salary so I quit company (A) and began working at company (B) immediately on June 15th 2009. Company (B) a month and 1/2 later on August 5th 2009, decided that my attendance was not acceptable and without giving me any write ups or warnings terminated me on the morning of August 5th when I arrived at work and already had someone there in the office trying out my position.

Dicetra, this should not be a problem. They may check with both employers to confirm your story and your rates of pay at both places, but as long as you are honest with your unemployment office, you should be fine.

Amadera, you do qualify for unemployment. Certain states will require you to accept a job within a certain distance from your home, but will not make you move across the country for a job. You have lost your current position through no fault of your own which makes you eligible for unemployment.

Chamonkey, it is unclear from your comment which state you currently live in and which state you are moving to, but you should contact the unemployment office in the state you are moving to. They will be able to advise you how to go about receiving unemployment in your new state. Generally, following your spouse to a new state is considered losing your job through no fault of your own, so you should be okay.
After working in NY for 8 years (and having money taken out bi-weekly contributing to unemployment in that state) I moved to Ohio. I have been working for a company for about 6 weeks, and was recently in a car accident which has caused me to take off several days from work for doctor's appointments, and general care. Now I have been issued a warning at this job, and they've informed me that if I were to take off another day I will be terminated since I am still under my first 90 days of unemployment. I worked for an agency for the past year and a half, and on July 1, 2009, it was taken over by a bigger agency. I was Laid off from the previous agency and still have the letter. As a new employee for the new agency I am currently on 6 months probation. In September, I will be in my second year of a graduate program and my current work schedule will not accommodate my class schedule. anels, the lay off letter from the previous agency will not be enough to qualify for unemployment. You currently have a job and if you leave that job willingly, you will not qualify for unemployment.
Question: I have worked in Utah for the company for 15 years. I want to relocate to Denver, CO. My company will not allow that. If I move there more than likely the company will terminate me. If that happens, would I qualify for unemployment? If so, would I be able to collect in Utah or Colorado?
Rod, if you leave your job willingly, you will not be able to collect unemployment. If your company agrees to transfer you and then terminates you, the case may be different. If they tell you that if you leave you will no longer have a job and you leave, you most likely won't be able to collect unemployment.
I was layed off my job 11 months ago. Because I was retimement elgible by age at the time, I started my retimement pay at the time I was layed off. Can I still apply for unemployment benifits at this time?
